§ 54-152. Towing.

  • (a)

    In general. Except as set forth in subsection (b) of this section, whenever any vehicle is authorized to be towed by the village police department, the owner, lessee or entity entitled to lawful possession of said vehicle shall pay an administrative charge to the village in the amount of $50.00 per tow.

    (b)

    Incident to arrest. Because of the additional time, testing and paperwork involved if a vehicle is towed in relation to an arrest for alcohol, felony drug, felony unlawful use of a weapon, solicitation of drugs, prostitution or solicitation of prostitution, or driving privilege revoked offenses, the owner, lessor or entity entitled to lawfully possess the vehicle, shall pay an administrative fee to the village in the amount of $500.00 per tow.

    (c)

    Collection of costs and fees. The village administrative charge shall be in addition to any other fees or costs that the towing company may otherwise charge by law for the towing and storage. Any towing company that tows a vehicle pursuant to authorization from the police department shall verify the village administrative charge has been paid before releasing the vehicle to the owner, lessee or entity entitled to lawful possession thereof.

    (d)

    Maximum towing fees. Any towing company, or person, which tows any vehicle authorized by the village to be towed shall charge no more than $125.00 for towing charges and $35.00 per day for storage fees.

    (e)

    Forfeiture procedure. For vehicles towed incident to an arrest, as set forth in subsection (b) of this section, the procedure set forth in article XIII of chapter 70 shall be followed.
